Welcome to NancyObeauty LLC (“Nancy O Beauty,” “we,” “our,” or “us”).
These Terms & Conditions (“Terms”) govern your access to and use of our websites, booking portals, training programs, and services, including nancyobeauty.com, padmaaesthetics.com, and any related landing pages or platforms (collectively, the “Services”).

By booking an appointment, enrolling in training, or using our websites, you agree to be bound by these Terms.
If you do not agree, please do not use our Services.

SECTION 1: SMS, TEXT, AND WHATSAPP MESSAGING TERMS

By providing your phone number through any form on our Services, you provide express written consent to receive informational, marketing, and promotional messages from NancyObeauty LLC via SMS/text and WhatsApp. These communications may use an automatic dialing system and may include prerecorded or automated messages.

Consent: Your consent is not a condition of any purchase.
Opt-Out: You may opt-out at any time by replying STOP. A final confirmation will be sent before ending communications.

Message Frequency: Message frequency varies based on your activity and preferences.

SECTION 2: USE OF OUR SERVICES

The information and materials provided through our websites or booking portals (including beauty consultations, educational content, or training resources) are for informational and educational purposes only.

SECTION 3: BEAUTY SERVICES

3.1 Appointments & Bookings

Appointments must be scheduled through our official booking system or authorized staff.
Availability is subject to confirmation.
We reserve the right to refuse or reschedule services as necessary.

3.2 Deposits & Payments

A non-refundable deposit may be required to secure your booking.
Deposits apply toward the final service cost.
Cancellations made less than 24 hours before an appointment forfeit the deposit.
Remaining balances are due at the time of service.

3.3 Cancellations & No-Shows

Cancellations made 24+ hours in advance may be rescheduled.
Same-day cancellations or no-shows result in loss of deposit.
Repeated no-shows may require full prepayment for future bookings.

3.4 Service Disclaimer

Results vary based on individual factors (skin type, lifestyle, aftercare).
Aftercare instructions will be provided; not following them may affect results.
Nancy O Beauty is not responsible for healing responses or pre-existing conditions.

3.5 Health & Safety

Clients must disclose allergies, medical conditions, or previous treatments.
We may decline service if contraindications exist.
By booking, you acknowledge and accept the risks associated with cosmetic treatments.

3.6 Liability Waiver

By receiving services, you release NancyObeauty LLC from liability for:

Allergic reactions
Complications from undisclosed conditions
Results differing from client expectations

SECTION 4: TRAINING PROGRAMS

4.1 Enrollment & Eligibility

Training is open to adults meeting the listed prerequisites.
Some courses may require previous beauty or PMU experience.

4.2 Payments & Deposits

Deposits secure enrollment and are non-refundable.
Tuition must be paid in full before the start date unless otherwise arranged.
All payments are final unless a written cancellation policy applies.

4.3 Certification & Licensing

Our training provides professional development and education.
Completion does not guarantee state licensure or certification.
Students are responsible for meeting all local licensing requirements.

4.4 Intellectual Property

All manuals, videos, and course materials belong to NancyObeauty LLC.
Students may not reproduce, resell, or distribute materials without written consent.

4.5 No Guarantee of Results

Success depends on the student’s effort, skill, and adherence to regulations.
We do not guarantee employment, clients, or financial results.

4.6 Refund Policy

Deposits are non-refundable.
Tuition may be transferable to future sessions at our discretion.

SECTION 5: INTELLECTUAL PROPERTY

All content, designs, text, graphics, videos, and materials on our websites and platforms are owned by NancyObeauty LLC or its licensors and protected by copyright and trademark law.
You may not reproduce, distribute, or create derivative works without written permission.

SECTION 6: DISCLAIMERS AND LIMITATION OF LIABILITY

Our Services are provided “as is” and “as available.”
We make no warranties, express or implied, about the functionality, accuracy, or reliability of our Services.

In no event shall NancyObeauty LLC, its owners, employees, or affiliates be liable for any indirect, incidental, special, or consequential damages resulting from your use or inability to use our Services.

SECTION 7: INDEMNIFICATION

You agree to indemnify and hold harmless NancyObeauty LLC, its owners, employees, and affiliates from any claims, damages, or expenses arising from your use of our Services, including violations of these Terms.

SECTION 8: GOVERNING LAW & DISPUTES

These Terms are governed by the laws of California, USA.
Disputes shall be resolved in the courts of San Diego County, California, unless otherwise required by law.

For international users, you acknowledge that U.S. law governs regardless of jurisdiction.
Unresolved disputes will be settled by binding arbitration in California under the American Arbitration Association (AAA) rules.
