Terms & Conditions of Service

These Terms & Conditions of Service (“Terms”) govern all services provided by NancyObeauty LLC (“Nancy O Beauty,” “we,” “our,” or “us”). By booking an appointment, enrolling in training, or using our software services, you agree to be bound by these Terms.

SECTION 1: BEAUTY SERVICES

1.1 Appointments & Bookings

All appointments must be scheduled through our official booking system or directly with authorized staff.
Appointment availability is subject to confirmation.
We reserve the right to refuse service or reschedule as necessary.

1.2 Deposits & Payments

A non-refundable deposit may be required to secure your booking.
Deposits are applied toward the final cost of your service.
If you cancel less than 24 hours before your appointment, your deposit will be forfeited.
Remaining balances must be paid at the time of service.

1.3 Cancellations & No-Shows

Cancellations made more than 24 hours in advance may be rescheduled.
Same-day cancellations or no-shows result in loss of deposit.
Repeated no-shows may require full prepayment for future bookings.

1.4 Service Disclaimer

Results vary depending on skin type, lifestyle, and aftercare.
Aftercare instructions will be provided; failure to follow them may affect results.
Nancy O Beauty is not responsible for outcomes outside our control (e.g., healing response, pre-existing conditions).

1.5 Health & Safety

Clients must disclose medical conditions, allergies, or prior treatments.
We reserve the right to decline service if contraindications exist.
By booking, you acknowledge and accept the risks associated with cosmetic treatments.

1.6 Liability Waiver

By receiving services, you release NancyObeauty LLC from liability for:

Allergic reactions.
Complications due to undisclosed conditions.
Results differing from expectations.

SECTION 2: TRAINING PROGRAMS

2.1 Enrollment & Eligibility

Training programs are open to adults who meet prerequisites described in course details.
Some courses may require prior beauty or PMU experience.

2.2 Payments & Deposits

Deposits are required to secure enrollment and are non-refundable.
Tuition balances must be paid by the start date, unless otherwise arranged.
All payments are final unless cancellation policies are expressly stated in writing.

2.3 Certification & Licensing

Training programs are designed for professional development.
Completion of a program does not guarantee state licensure or certification.
Students are responsible for complying with local licensing requirements.

2.4 Intellectual Property

Training materials, manuals, videos, and other content are the property of NancyObeauty LLC.
Students may not reproduce, resell, or distribute training materials without written consent.

2.5 No Guarantee of Results

We provide education and guidance, but success depends on the student’s skill, effort, and compliance with regulations.
Nancy O Beauty does not guarantee employment, client acquisition, or income results.

2.6 Refund Policy

Training deposits are non-refundable.
Tuition may be transferable to future courses only at our discretion.

SECTION 3: SOFTWARE / CRM / SAAS SERVICES

3.1 Service Access

Nancy O Beauty may provide access to software, CRM, booking, or marketing platforms under our brand (including white-label solutions).
Use of these services constitutes agreement to these Terms.

3.2 Account Responsibilities

Users must provide accurate account details.
You are responsible for maintaining the confidentiality of login credentials.
Unauthorized access or misuse of accounts is prohibited.

3.3 Acceptable Use

You agree not to use the platform for:

Sending spam, illegal, or abusive communications.
Storing or transmitting harmful code or malware.
Violating applicable data protection or marketing laws (e.g., CAN-SPAM, GDPR).
Infringing intellectual property or third-party rights.

3.4 Payments & Renewals

SaaS/CRM services may be subscription-based.
Fees are due in advance of the billing cycle.
Failure to pay may result in suspension or termination of service.
Chargebacks are strictly prohibited and may result in termination of access.

3.5 Service Availability

We strive for continuous service but do not guarantee uninterrupted uptime.
Scheduled maintenance or unforeseen outages may occur.
Nancy O Beauty is not liable for data loss or service disruptions.

3.6 Termination

We may suspend or terminate accounts for misuse, non-payment, or violation of these Terms.
Users may cancel at any time, but no refunds are issued for partial billing periods.

3.7 Data Ownership & Privacy

Users retain ownership of data entered into the platform.
By using the platform, you grant us the right to process and store such data for the purpose of providing services.
Data is handled according to our Privacy Policy.

3.8 Liability Disclaimer

Nancy O Beauty is not responsible for damages caused by misuse of the platform.
We are not liable for indirect, incidental, or consequential losses arising from SaaS use.
Total liability is limited to the subscription fees paid in the 12 months preceding the claim.

SECTION 4: GENERAL TERMS (APPLY TO ALL SERVICES)

4.1 Indemnification

You agree to indemnify and hold harmless NancyObeauty LLC, its owners, staff, and affiliates from claims, damages, or expenses arising from your use of services.

4.2 Governing Law

These Terms are governed by the laws of California, USA. Disputes shall be resolved in the courts of San Diego County, California.

4.3 Arbitration Clause

For disputes not resolved amicably, you agree to binding arbitration in California under the rules of the American Arbitration Association (AAA).

4.4 International Clients

Our services are offered globally. By using them, you agree that U.S. law governs, regardless of your jurisdiction.

4.5 Updates to Terms

We may update these Terms at any time. Updates are effective once posted at nancyobeauty.com/terms-and-conditions.
